TxUESI & TxDOT Information Exchange Session

TxDOT has officially published the following updated and new items on internal and external Utility Accommodation Toolkits under “Training” to assist you with understanding the Buy America program for reimbursable utility relocations on TxDOT highway projects. Texas UESI has scheduled a virtual TxDOT/UESI Information Exchange Session on July 21, 2021 from 9:00 – 10:30 AM where they will present on the latest updates as it relates to the Buy America program. Please use the form below to register for the session.

Approved Buy America Guidelines –  TxDOT Buy America Guidelines approved by FHWA. Latest version is 5/2021.

****IMPORTANT UPDATE: The 2nd paragraph under “Guidelines” (pdf page 5) was added to emphasize all manufacturing processes must occur in the United States. This was the only major change made. To avoid delays in utility relocations and highway construction projects, this version of the guidance allows for a limited transition period through May 5, 2022 (standard utility agreement execution date will be used as the basis for the date). This limited transition period is provided to allow utility companies to perform business operations activities necessary to ensure compliance with the new revisions to the Buy America guidelines regarding manufacturing process. These activities may include execution of new contracts with suppliers or revisions to existing contracts as well as implementation of revisions to internal purchasing and logistics processes. Please note that the limited transition period only applies to the additional material items incorporated in this version of the revised guidelines. Utility companies are still required to be compliant with the Buy America guidelines in effect prior to the most recent revision date.

****IMPORTANT UPDATE: The FAQ document has been updated to remove stopple fittings from requiring Buy America compliance. Effective immediately, fittings are classified as an attachment material; therefore, it does not require Buy

America compliance. Stopple fittings are considered a fitting. If you have older projects where it was required for stopple fittings to be Buy America compliant, simply make a note in your billing submittal “as per the latest Buy America guidelines, a stopple fitting is considered a fitting and therefore does not require Buy America compliance.”

Utility Coordination Buy America Verification Form (ROW-U-BAV) – Buy America Verification Form used to document verified materials. This is an optional form to assist on projects.

Buy America Training Videos (found on External Utility Accommodation Toolkit only)- This series of videos is intended to assist utility companies, vendors, manufacturers, and consultants to understand the Buy America Program from beginning to end of a project’s life cycle and to ensure compliance. TxDOT employees are encouraged to view these videos for course credit through “ROW102 – Buy America Requirements for Utility Accommodations” once it becomes available in PeopleSoft (summer 2021). In the meantime, you can definitely watch the videos currently published but will need to sign up through ELM for credit.
